1. Acceptance of Terms
By accessing or using Evolution AI's website, platform, and services (collectively, the "Services"), you agree to be bound by these Terms & Conditions. If you do not agree to all of these terms, you may not access or use the Services.
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Services following any changes constitutes acceptance of those changes.
2. Use License
Subject to these Terms, Evolution AI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes. This license does not include the right to sublicense, resell, or distribute any part of the Services.
You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Services without express written permission from Evolution AI.
3. User Accounts
To access certain features of the Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. Evolution AI reserves the right to suspend or terminate your account if any information provided proves to be inaccurate or incomplete.
4. Intellectual Property
The Services, including all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, software, and the compilation thereof), are owned by Evolution AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Any feedback, suggestions, or ideas you provide regarding the Services may be used by Evolution AI without any obligation to compensate you, and Evolution AI retains all rights to such feedback.
5. Prohibited Uses
You may not use the Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Services. You may not attempt to gain unauthorized access to any part of the Services, other accounts, computer systems, or networks connected to the Services.
You agree not to use any automated means, including robots, crawlers, or scrapers, to access the Services for any purpose without our express written permission.
6. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Evolution AI does not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. No advice or information obtained from Evolution AI shall create any warranty not expressly stated in these Terms.
7. Limitation of Liability
In no event shall Evolution AI, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Services.
Evolution AI's total liability to you for all claims arising from or related to the Services shall not exceed the amount paid by you, if any, to Evolution AI during the twelve (12) months preceding the claim.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Tel Aviv, Israel.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
